Terms of Use & Privacy Statement

Privacy Reminder -This page states the "Terms of Use" under which you may use an on-line service to post and search employment services (ProTechResume.com"), referred to herein as ProTech Resume Inc..

These Terms of Use include the ProTech Resume Privacy Statement, which is incorporated into these Terms of Use by reference. By using ProTech Resume, You are indicating your agreement to these Terms of Use, including the ProTech Resume Privacy Statement.

Please read this page carefully. If You do not accept the Terms of Use stated here, do not use the Web Site and the services. By using ProTech Resume, you are indicating your acceptance to be bound by the provisions of these Terms of Use. ProTech Resume (the "Company") may revise these Terms of Use at any time by updating this posting. You should visit this page periodically to review the Terms of Use, because they are binding on You. 1. Eligibility

You must retain all copyright, trademark, servicemark and other proprietary notices contained in the original Content on any copy You make of the Content. You may not sell or modify the Content or reproduce, display, publicly perform, distribute, or otherwise use the Content in any way for any public or commercial purpose. The use of the Content on any other web site or in a networked computer environment for any purpose is prohibited.

You shall not copy or adapt the HTML code that the Company creates to generate any Content or the pages making up any ProTech Resume site, which is also protected by the Company's copyright.

4. Policy Regarding Termination Of Users Who Repeatedly Infringe The Copyright Or Other Intellectual Property Rights Of Others

ProTech Resume respects the intellectual property of others, and we ask our users and content partners to do the same. The unauthorized reproduction, copying, distribution, modification, public display or public performance of copyrighted works constitutes infringement of the copyright owners rights. As a condition to your use of ProTech Resume, You agree not to use ProTech Resume to infringe on the intellectual property rights of others in any way. We will terminate any User’s ability to access ProTech Resume who repeatedly infringe on the copyrights or other intellectual property rights, of others. We reserve the right to take these actions at any time, in our sole discretion, with or without notice, and without any liability to the User whose access is blocked.

5. The Company's Liability

ProTech Resume acts as a venue for candidates to obtain resume services and employment advice and does not screen or censor the listings offered. The Company is not involved in the actual transaction between employers and candidates. As a result, the Company has no control over the quality, safety or legality of the jobs or resumes posted, the truth or accuracy of the listings, the ability of employers to offer job opportunities to candidates or the ability of candidates to fill job openings or any User Content and makes no representations about any jobs or User Content on ProTech Resume.

In addition, note that there are risks, including but not limited to the risk of physical harm, of dealing with strangers, foreign nationals, underage persons or people acting under false pretenses. You assume all risks associated with dealing with other users with whom You come in contact through ProTech Resume. By its very nature, other people's information may be offensive, harmful or inaccurate, and in some cases will be mislabeled or deceptively labeled. We expect that You will use caution and common sense when using ProTech Resume.

Because user authentication on the Internet is difficult, the Company cannot and does not confirm that each User is who they claim to be. Because we do not and cannot be involved in user-to-user dealings or control the behavior of participants on ProTech Resume, in the event that You have a dispute with one or more Users, You release the Company (and our agents and employees) from claims, demands and damages (actual and consequential, direct and indirect) of every kind and nature, known and unknown, suspected and unsuspected, disclosed and undisclosed, arising out of or in any way connected with such disputes. If You are a California resident, You waive California Civil Code Section 1542, which says: "A general release does not extend to claims which the creditor does not know or suspect to exist in his favor at the time of executing the release, which if known by him must have materially affected his settlement with the debtor."

ProTech Resume Content may contain inaccuracies or typographical errors. The Company makes no representations about the accuracy, reliability, completeness, or timeliness of any content. The use of ProTech Resume is at your own risk. Changes are periodically made to ProTech Resume Inc. and may be made at any time.

You acknowledge and agree that You are solely responsible for the form, content and accuracy of any resume or material contained therein placed by You on ProTech Resume.

The Company is not to be considered to be an employer with respect to your use of ProTech Resume and the Company shall not be responsible for any employment decisions, for whatever reason, made by any entity posting jobs on ProTech Resume.

ProTech Resume cannot guarantee and does not promise any specific results from use of your resume template, cover letter, or reference pages, in addition to job recruiters submitted. No advice or information, whether oral or written, obtained by a User from ProTech Resume shall create any warranty not expressly stated herein.

6. Disclaimer of Warranty

THE COMPANY DOES NOT WARRANT THAT IT WILL OPERATE ERROR-FREE OR THAT ITS SERVERS ARE FREE OF COMPUTER VIRUSES OR OTHER HARMFUL MECHANISMS. IF YOUR USE OF PROTECH RESUME CONTENT RESULTS IN THE NEED FOR SERVICING OR REPLACING EQUIPMENT OR DATA, THE COMPANY IS NOT RESPONSIBLE FOR THOSE COSTS. PROTECH RESUME CONTENT IS PROVIDED ON AN "AS IS" BASIS WITHOUT ANY WARRANTIES OF ANY KIND. THE COMPANY, TO THE FULLEST EXTENT PERMITTED BY LAW, DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING THE WARRANTY OF MERCHANTABILITY, FITNESS FOR PARTICULAR PURPOSE AND NON-INFRINGEMENT. THE COMPANY MAKES NO WARRANTIES ABOUT THE ACCURACY, RELIABILITY, COMPLETENESS, OR TIMELINESS OF THE CONTENT, SERVICES, SOFTWARE, TEXT, GRAPHICS, AND LINKS HEREIN.

7. Disclaimer of Consequential Damages

IN NO EVENT SHALL THE COMPANY, ITS SUPPLIERS, OR ANY THIRD PARTIES MENTIONED ON PROTECH RESUME BE LIABLE FOR ANY DAMAGES WHATSOEVER (INCLUDING, WITHOUT LIMITATION, INCIDENTAL AND CONSEQUENTIAL DAMAGES, LOST PROFITS, OR DAMAGES RESULTING FROM LOST DATA OR BUSINESS INTERRUPTION) RESULTING FROM THE USE OR INABILITY TO USE THE PROTECH RESUME SITE AND PROTECH RESUME CONTENT, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT THE COMPANY IS ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

8. Limitation of Liability

PROTECH RESUME MAXIMUM LIABILITY ARISING OUT OF OR IN CONNECTION WITH ANY THE PROTECH RESUME SITE OR YOUR USE OF THE PROTECH RESUME CONTENT, REGARDLESS OF THE CAUSE OF ACTION (WHETHER IN CONTRACT, TORT, BREACH OF WARRANTY OR OTHERWISE), WILL NOT EXCEED $10.00.

9. Links to Other Sites

ProTech Resume may contain links to third party web sites, and job search sites. These links are provided solely as a convenience to You and not as an endorsement by the Company of the contents on such third-party Web sites. The Company is not responsible for the content of linked third-party sites and does not make any representations regarding the content or accuracy of materials on such third party Web sites. If You decide to access linked third-party Web sites, You do so at your own risk.

10. NO RESALE OR UNAUTHORIZED COMMERCIAL USE

You agree not to resell or assign your rights or obligations under these Terms of Use. You also agree not to make any unauthorized commercial use of ProTech Resume.

11. INDEMNITY

You agree to defend, indemnify, and hold harmless the Company (ProTech Resume Inc.), its affiliates, and their respective officers, directors, employees and agents, from and against any claims, actions or demands, including without limitation reasonable legal and accounting fees, alleging or resulting from (i) any User Content or other material You provide to ProTech Resume Inc., (ii) your use of any ProTech Resume Content, or (iii) your breach of the terms of these Terms of Use. The Company shall provide notice to You promptly of any such claim, suit, or proceeding.

12. GENERAL

The Company makes no claims that the ProTech Resume Content may be lawfully viewed or accessed outside of the United States. Access to the ProTech Resume Content may not be legal by certain persons or in certain countries. If You access ProTech Resume from outside of the United States, You do so at your own risk and are responsible for compliance with the laws of your jurisdiction. These Terms of Use are governed by the internal substantive laws of the State of California, without respect to its conflict of laws principles. Jurisdiction for any claims arising under this agreement shall lie exclusively with the state or federal courts within Los Angeles California. If any provision of these Terms of Use is found to be invalid by any court having competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions of these Terms of Use , which shall remain in full force and effect. No waiver of any term of these Terms of Use shall be deemed a further or continuing waiver of such term or any other term. Except as expressly provided in an additional agreement, additional terms of use for areas of ProTech Resume, a particular "Legal Notice," or Software License or material on particular Web pages, these Terms of Use constitute the entire agreement between You and the Company with respect to the use of ProTech Resume No changes to these Terms of Use shall be made except by a revised posting on this page.

13. TERM AND TERMINATION

These Terms of Use will remain in full force and effect while You are a User of ProTech Resume at any level. The Company reserves the right, at its sole discretion, to pursue all of its legal remedies, including but not limited to terminate your ability to access ProTech Resume Inc. or any other services provided to You by the Company, upon any breach by You of these Terms of Use or if the Company is unable to verify or authenticate any information that You submit to ProTech Resume. Even after You are no longer a User of ProTech Resume, certain provisions of these Terms of Use will remain in effect, including Sections 2 through 13, inclusive.

14. PROTECH RESUME PRIVACY STATEMENT

Protecting the privacy of the information you submit to ProTechResume.com is of great importance to us. We will use our best efforts to ensure that submitted information is kept private and used only in the ways described below. 15. PERSONAL INFORMATION

Your resume and all the information submitted for preparation of your resume is considered strictly private, and unless we believe we are required by law to do so, ProTechResume.com will not disclose that information to anyone without your authorization, provided in accordance with your opt-out/opt-in elections at registration with us, or thereafter, consistent with your changes to such elections at any time in your user profile. ProTechResume.com will never use your information or share your information with marketing partners. With your authorization, ProTechResume.com may use your information to make you aware of additional products and services that we believe may be of interest to you, or to contact you regarding site changes. You may opt-out of receiving certain services or communications from ProTechResume.com.

16. STATISTICAL INFORMATION

ProTechResume.com gathers collective information about our users and their use of our site. This data may be used anonymously and in the aggregate in order to improve our services and in connection with planning, marketing, and advertising our services. We do not disclose information about your individual visits to ProTechResume.com, or personal information that you provide, such as your name, address, e-mail address, telephone number, credit card number, etc., to any outside parties, except when we believe the law requires it or when you have authorized it. If ProTechResume.com needs to contact you regarding questions about your resume while it's being written (for example, if you forgot to enter some important information), we will try to reach you by e-mail first. In the event we must contact you by telephone regarding your resume, we will use our best efforts to contact you as discreetly as possible.

19. SECURITY

When you place an order online at ProTechResume.com, your personal details and credit card information are scrambled using PAYPAL SSL encryption technology before being sent over the Internet. Although we cannot guarantee PAYPAL encryption or the privacy of your personal details and credit card information, PAYPAL SSL makes it very difficult for your information to be stolen or intercepted while being transferred.

20. COOKIES

ProTechResume.com uses "cookies" in order to improve our customers use of the site. Cookies enable us to remember customer user names, passwords and preferences, and track your use of our site, enabling us to deliver a faster, personalized, consistent service.

22. REFUND TERMS

If you are not completely satisfied, contact our customer service department immediately and we will make every attempt to correct the problem. If we cannot do this, and customer service is not available to assist you in a reasonable time, we will authorize a 100% refund.
